A FOUL-MOUTHED yob threatened and shouted abuse at bus passengers, then struggled with the driver – all before the bus left Dunfermline station.

Kyle Peter Maguire, 23, refused to stop swearing despite being asked to do so – and his loutish behaviour has now resulted in a jail sentence.

Maguire, who appeared for sentencing on Wednesday, admitted that on September 19 last year at Dunfermline bus station, he behaved in a threatening or abusive manner, shouted, swore, uttered offensive remarks, uttered threats of violence, challenged others to a fight and struggled with the bus driver. He committed the offence while on bail.

Fiscal depute Fiona Nairn told Dunfermline Sheriff Court that Maguire and a woman boarded the Stagecoach bus around 8pm and took seats at the rear.

She said: “As soon as they sat down, they began shouting and swearing to each other and generally acting in an aggressive manner.

“They continued acting in this manner for a few minutes until one of the passengers asked them to refrain from swearing as there were children on the bus.

“On hearing this, the accused turned his aggression on the passenger, saying, 'Shut your f***ing face, shut the f*** up.'

“The passenger was disturbed by this behaviour and, fearful that things would escalate, went to the front of the bus to complain to the driver.”

The driver spoke to Maguire and his companion and told them the bus was not moving off from the station until their behaviour improved.

Maguire continued to shout and swear, abusing the other passengers. He then went down the aisle of the bus and became involved in a struggle with the bus driver.

Maguire swore again and challenged the passengers to a fight, shouting abuse, before he and this companion ran off.

Solicitor Steve Gleeson acknowledged that it was a “rather unsavoury” incident but said Maguire, of 21 Brodie Court, Glenrothes, had little recollection of it.

He conceded that Maguire had previous analogous convictions and did not have a good record at complying with court orders.

He revealed that Maguire had spent a “substantial period” of his childhood in care and secure accommodation, adding: “Since his last community payback order, it would appear his level of offending has reduced.”

Jailing Maguire for 10 months, Sheriff Craig Sherry lambasted: “This was at 8pm on a bus with passengers, including children. 

“You were shouting, swearing, refusing to desist and struggling with the bus driver, and you did this on bail.”
