A KELTY man caught with a golf club and a knife after a row over noise was given a restriction of liberty order.

Lee James, 37, of Lochleven Terrace, had been at a neighbour's party and left at midnight when he believed it was finishing.

However, it continued and got louder which caused him to complain.

Appearing for sentencing at Dunfermline Sheriff Court, he admitted that on July 13, at a pavement and garden area in Loch Leven Terrace, he had offensive weapons – namely a golf club and a knife – in a public place without reasonable excuse or authority.

Depute Fiscal Dev Kapadia said police received an anonymous call about a disturbance and arrived to see an agitated and upset James waving a golf club while shouting.

When they moved away from the property, he gave them a knife which had been in his jeans pocket and said he was "just threatening them" in relation to his neighbours.

Defence solicitor Ian Beatson said his client had been at the neighbour's house and consumed alcohol.

He believed the party was coming to an end at around midnight and left however the music levels then increased.

"He asked them to turn it down," Mr Beatson told the court. "He cannot understand why he was so stupid to act in the manner he did.

"His drinking has been fairly problematic for him – he describes this as a wake up call and has radically decreased his drinking."

Sheriff Craig McSherry placed James on a community payback order with a supervision requirement for 12 months.

He also sentenced him to a restriction of liberty order for two months when he will be required to stay in his home between 7pm and 7am.
