A DUNFERMLINE man attacked a neighbour claiming he had kicked his dog.

Kevin Malcolm said his pet was kicked and he responded with violence.

Malcolm, 37, of Broomhead Drive, appeared at Dunfermline Sheriff Court.

He admitted that on December 17 last year at Broomhead Drive, he assaulted a man by repeatedly punching and kicking him on the head to his injury.

He was also due to be sentenced for an earlier offence.

Malcolm admitted that on October 19, 2016 at Pilmuir Street, Queen Anne Street and Carnegie Drive he engaged in a fight with two males and committed a breach of the peace.

Depute fiscal Azrah Yousaf said: “The complainer and the accused stay in the same block of flats.

“At around midnight the complainer had taken his dog out. When he was coming out of the lift he saw the accused with his dogs.

“Words were exchanged between them about the dogs. The accused then punched the complainer three times to the side of the face and also kicked him on the face.”

The police were contacted and Malcolm told officers: “I done it because he kicked my dog.”

The victim sustained bruising to the side of his face.

Defence solicitor Gordon Martin said his client was currently on a drug treatment and testing order and invited Sheriff Derek Reekie to defer sentencing to monitor his progress on the order.

Sheriff Reekie told Malcolm: “Whether there was any issue with your dog in the lift, for you to react in that way is very serious.”

He agreed to defer sentencing until October 12 to monitor Malcolm’s progress on the DTTO.
