A MAN carried out an assault in a Dunfermline nightclub because he thought his victim had assaulted his sister.

Ben Sprunt, 23, of Sycamore Avenue, Kirkcaldy, appeared for sentencing at Dunfermline Sheriff Court last Wednesday after earlier admitting assaulting a man at Harlem nightclub on November 22, 2015, by punching him on the head to his injury.

He also resisted, obstructed or hindered two police officers in the execution of their duty by struggling violently with them and lashing out with his arms and legs.

Charges of failing to appear at Dunfermline Sheriff Cour on May 5 and September 1 last year were also admitted.

Depute fiscal Claire Bremner said the victim was in the bar area of the nightclub with friends when Sprunt walked up to him and punched him once on the face.

Members of staff saw the incident and Sprunt was restrained and taken outside the nightclub. Police were already outside dealing with another incident and saw him struggling with nightclub staff.

Solicitor Rosni Joshi said her client had consumed too much alcohol and there had been a case of mistaken identity.

"He had understood the complainer to have assaulted his sister in some way," she said.

"Given his alcohol consumption and his feelings of anger, he acted in the manner described."

Sheriff Craig McSherry placed Sprunt on a restriction of liberty order for four months for the assault while he deferred sentence on the failure to appear at court charges for three months for him to be of good behaviour.
