A DUNFERMLINE man who committed a sex act at his livingroom window and was seen by a female neighbour has been fined £400.

Robert Dempsey, 45, formerly of Fieldfare View, appeared at Dunfermline Sheriff Court for sentencing.

He admitted that on November 27 at that address he conducted himself in a disorderly manner by masturbating in front of a window inside the house where he could be seen by others from outside and committed a breach of the peace.

Depute fiscal Claire Bremner said that at 10.40am a female neighbour was in her bedroom when she looked out of the window and saw Dempsey standing at his living room window.

The top of his body was naked and he had blue clothing pulled down to the top of his thighs.

“She saw he was masturbating and her perception was that he was looking up towards her," the depute said.

“She was alarmed, pulled back from her window for a few seconds then looked again. He was still masturbating and looking up towards her window.”

The woman contacted the police and when they went to speak to Dempsey he said: “It’s totally untrue.”

However, when he was taken to the police station he admitted he had been standing at the window masturbating but had not seen the neighbour.

“He said he was deeply upset that she had seen him,” added the depute.

Defence solicitor Selina Mackay previously told the court that her client was now living in a new address in Woodmill Crescent.

She said of the incident: “He had not intended for anybody to see him.”

There were blinds on the window closed over but tilted in such a way that he could be seen from some houses nearby.

“He accepts that was reckless of him and recognises his behaviour was inappropriate. He feels totally humiliated having to come to court,” added Ms Mackay.

Sheriff Chris Shead fined Dempsey £400.
