A KARAOKE entertainer who ended up down an embankment after driving at high speed and dangerously on the motorway near Dunfermline has been banned from driving.

Garry Kendall, 39, lost control of his car in what he described as a "massive error of judgement" during the incident on the M90 earlier this year.

He appeared for sentencing at Dunfermline Sheriff Court after previously admitting that on March 15, between junction 3 Halbeath and junction 4 Kelty, he drove car dangerously and failed to keep a safe distance between his vehicle and the one in front.

He admitted driving at excessive speed, failing to keep control of his vehicle and causing it to collide with the central reservation and leave the carriageway.

Solicitor Stephen Morrison said his client, of Brucefield Avenue, accepted he had been going at around 80 miles an hour when he encountered a BMW in the fast lane.

"The BMW had the opportunity to go in the slow lane but didn't, however Mr Kendall's error of judgement appears to be he expected the vehicle would pull over," he said. "He hit the brakes and lost control of his vehicle and, to avoid a collision with the BMW, he pulled into the slow lane which he had room to do."

Kendall then over-corrected his manoeuvre which saw him entering the fast lane in front of the other car at right angles. He hit the central reservation before bouncing back across the carriageway and ending up down an embankment.

"Entirely through luck rather than design, there was no collision with other vehicles," added Mr Morrison. "He accepts full responsibility.

"He described his behaviour as a massive error of judgement."

Sheriff Alastair Thornton told Kendall it had been "dreadful driving".

He added: "You have a record which includes several previous convictions of careless driving or driving without due care and attention. A financial penalty would not be sufficient to show the court's disapproval of this matter."

He placed him on a community payback order with 200 hours of unpaid work to be completed within nine months and also ordered Kendall to take part in road traffic group work sessions.

He was also banned him from driving for 22 months with a requirement that he will need to sit the extended driving test before he can get his licence back.
