A SHOP assistant from Rosyth assaulted his ex-partner after she said she'd been with someone else.

The relationship was over and Kevin Webb said he became angry when the woman "admitted her infidelity".

At Dunfermline Sheriff Court, the 21-year-old of Torridon Drive admitted that on February 12 at an address in Cowdenbeath, he assaulted his ex-partner, struck her on the hand causing her to drop a cigarette, repeatedly kicked her on the body, seized her by the clothing and body and caused her to fall to the ground.

Depute fiscal Azrah Yousaf said that the couple had split up in February and the complainer started to receive texts asking if they could reconcile, but she told him to stay away.

Webb then sent a message that said he was standing outside and he demanded to know what house his ex-partner was in.

When she went outside for a cigarette he threw it out of her hand and repeatedly kicked her.

He said to her: “You deserved this a long time ago.”

When others heard screaming the police were called.

Defence solicitor Selina Mackay said her client’s position was that his ex-partner had invited him to come and speak so they could discuss matters.

She said that Mr Webb had previously been in a relationship where his partner was unfaithful with his best friend and became pregnant, so became angry when the complainer admitted her infidelity to him.

“It upsets him to think of how this has impacted the complainer," Ms Mackay added.

Sheriff Craig McSherry imposed a community payback order of 12 months supervision.

“Giving the repeated kicking involved in this assault, this sentence is a direct alternative to custody," he told Webb.
