THE KILLER of tragic Madison Horn has abandoned the legal appeal against his conviction for the Kelty tot’s murder.

Kevin Park (27), was jailed for 22 years last November for the murder of the two-year-old in her own home last Easter. Judge Michael O’Grady QC called the crime “wicked beyond all imagining” while police welcomed the life sentence and said the killing had been “unimaginable, despicable and beyond any understanding.” The brutal attack came at the child’s own home on Croftangry Road on 20th April 2014. Park was supposed to be babysitting Madison while her mum Ann Marie White went to a friend’s birthday celebration in Cowdenbeath.

He battered the tot’s head off a wall at least twice, punched and stamped on her and prosecutors believe he may have also used a broken pool cue in the violent and sustained attack.

He also grabbed or pinched the ears of tiny Madison, who weighed 13.3kg and was 90.5cm tall, causing horrific bruising.

Her skull was fractured and she suffered internal bleeding and tearing to her liver. In total she had 65 separate injuries.

The Scottish Court Service confirmed in December that Park had lodged a notice of intention to appeal against the guilty verdict. Now, because of the time that has lapsed, the appeal has been deemed abandoned unless an application is lodged for an extension.

A spokesperson for the Judicial Office for Scotland said, “The appeal has been deemed abandoned as the substantive note of appeal was not lodged within the relevant time limit. However, it remains open for an application to be lodged on behalf of the convicted person to request an extension of time in order to submit a note of appeal.”
