PROPERTY FACTORS (SCOTLAND) ACT 2011 PUBLIC NOTICE UNDER SECTION 9(3)

The Scottish Ministers hereby give public notice of removal of the property factors named below from the Property Factor Register under section 4(7) of the Property Factors (Scotland) Act 2011: E D Construction Ltd 10/54 Partick Bridge Street

The date of removal is 17 January 2017
This means the relevant date under section 9(2) of the Property Factors (Scotland) Act 2011 (effect of removal) is 18 January 2017. Accordingly, after 18 January 2017:
- No costs incurred by the property factors in respect of work instructed after 18 January 2017 are recoverable;
- No charge imposed by the property factors which relates to a period after 18 January 2017 is recoverable;
- Homeowners may appoint new property factors (or decide to manage their properties without appointing a property factor) in accordance with the procedures made in relation to such decisions in their title deeds or, as the case may be, the Tenement Management Scheme; and
- The property factors may not lodge a notice of potential liability for costs under section 13(1) of the Tenements (Scotland) Act 2004 (asp 11) in respect of work instructed after 18 January 2017.
