THE INCH CAPE OFFSHORE WIND FARM (ONSHORE WORKS) COMPULSORY PURCHASE ORDER 2019

Notice is hereby given that INCH CAPE OFFSHORE LIMITED in exercise of the powers conferred by the above mentioned Acts, on 29th April 2019, made the above mentioned Compulsory Purchase Order which affects the land described in the Schedule hereto, for the purpose of carrying on activities which Inch Cape Offshore Limited is authorised by its generation licence to carry on in respect of the onshore works associated with the proposed Inch Cape Offshore Wind Farm.

The Order is about to be submitted to the Scottish Ministers for confirmation and comes into operation only if confirmed. If the Order is confirmed, a conveyance registered in implement of the Order may vary or extinguish rights to enforce real burdens and servitudes affecting the land.

A copy of the Order and the map referred to therein have been deposited at the locations identified below and may be seen there without payment of fee during the hours and on the days as follows:

SCHEDULE

New Rights to be Acquired

Servitude rights (the "Cable Rights") to enter and remain upon the land described below (the "Order Land") for the purposes of the installation and construction, operation, maintenance, replacement, repair and decommissioning of and access to the Cables (as defined in the Order) (and associated works in their respect), including the following unrestricted rights:

a) to carry out any site, soil, environmental and archaeological surveys and investigations, preliminary pre-construction tests surveys and works on the Order Land;



b) to install (by trenching, horizontal directional drilling or otherwise), construct, use, operate, inspect, maintain, repair, replace, renew, divert and/or remove the Cables in, on or under the Order Land and to obtain access over the Order Land for such purposes;



c) to create, carry out, install and use portacabins, portaloos, works compounds, laydown areas, temporary access roads and tracks, drainage, ground improvements and associated works in their respect on the Order Land and to obtain access over the Order Land for such purposes;



d) to enter the Order Land for the purpose of carrying out any drainage works or improvements ancillary to the Cables;



e) to enter the Order Land for the purposes of removing any buildings, other erections, workings or land formations which are constructed, placed or permitted within the Order Land which might in the sole opinion of the acquiring authority injuriously affect the Cables or the use and operation of the Cables or hinder or restrict access thereto for any of the purposes of the Order;



f) to lop, cut or remove any trees, shrubs or bushes as shall be grown, cultivated or permitted to be grown on the Order Land, which might, in the sole opinion of the acquiring authority, hinder, restrict or interfere with the Cables or the use and operation of the Cables, or the future use, operation, inspection, maintenance, repair, replacement, enlargement or removal of the Cables, and to obtain access over the Order Land for such purposes;



g) to prevent any works on or uses of the Order Land which may damage, interfere or injuriously affect the Cables or interfere with or hinder in any way the acquiring authority's access to the Cables and, in particular and without prejudice to the generality of the foregoing:



(i) the right to prevent and remove the whole or any part of any building or other erection or works, tree, shrub or bush or other thing whatsoever on the Order Land; and



(ii) the right to prevent or remove any works or uses which alter the surface level, ground cover or composition of the Order Land; and



h) of necessary pedestrian and vehicular access over the Order Land for the purposes of exercising all other Cable Rights.
