A MAN who told a worker at an Indian takeaway in High Valleyfield to go "back to where he came from" has been jailed for 12 months.

Ian Kelly racially abused one of the staff and told him he would "sort you out" after his former partner started an argument in the shop.

He appeared at Dunfermline Sheriff Court and was also sentenced for a number of incidents of threatening behaviour.

Two witnesses were working at Tasty Bite Indian takeaway on January 28 last year when at about 6.15pm Kelly attended with his partner, the court heard.

Depute fiscal Alistair McDermid said the woman starting shouting, asking why the police had attended the shop on several occasions and why they were also speaking to her family members.

"There appears to have been a remonstration between the woman and the staff," Mr McDermid said.

Kelly then intervened and said to one worker: "Who do you think you are? We will sort you out."

He called him a "Paki" and told him to "go back to where he came from".

In another incident, on February 4, 2017 in High Valleyfield, a woman saw two females getting in a car with Kelly.

He shouted at her: "That wee woman is getting done" and "I'm going to f***ing kill youse".

The accused was then seen bouncing around the seat of the car and pointing at the witness.

In a domestic incident on November 20, 2017, two witnesses were in their home address at about 8am when they became aware of Kelly and his partner arguing.

Mr McDermid said: "Through the course of the morning it became more heated."

Kelly's partner was heard shouting something similar to "You are a junkie" and in response he said, "You just sleep with anyone".

Shouting continued and at some point, Kelly caused damage to his partner's mobile phone by stamping on it.

Kelly, 31, now of Lorretto Care, Inchyra Place, Grangemouth, previously admitted that on January 28, 2017 at Tasty Bite Indian Take Away, Valleyfield Avenue, High Valleyfield, he acted in a racially aggravated manner which caused or was intended to cause alarm and distress to a male, acting in the course of his employment, by shouting, swearing, uttering threats of violence and racial remarks.

He admitted that, on February 4, 2017 at Leighton Street, High Valleyfield, he behaved in a threatening manner likely to cause fear or alarm in that he did shout, swear and utter threats of violence.

Kelly pleaded guilty that, on November 20, 2017 at Pentland Terrace, High Valleyfield, he behaved in a threatening or abusive manner likely to cause fear or alarm by repeatedly shouting and swearing at his partner, stamping on her mobile phone and causing damage to it.

And, having been granted bail on December 1, 2017, on the condition that he would appear in court when required, he failed to attend on June 14 this year without reasonable excuse.

Defence solicitor Aime Allan said: "Mr Kelly offers his apologies for his behaviour. He understands the court will be thinking about a custodial sentence.

"These offences are dated back to some time now. He was suffering from a drink and drugs addiction.

"They relate to a previous partner who Mr Kelly is no longer with."

Kelly was jailed for a total of 12 months.
