A DUNFERMLINE man who was drunk and disorderly after a funeral has been placed on a community payback order. 

Fogarty, 43, of Clunie Road, previously admitted that on August 2, at Whitelaw Crescent, he behaved in a threatening or abusive manner which was likely to cause a reasonable person to suffer fear or alarm in that he did shout, swear, act in an aggressive manner and kick a door, and did commit this while on bail. 

Depute fiscal Azrah Yousaf explained that the address where the offence happened was that of the partner of the accused and that they had been at a funeral together that day. 

At 6pm, Fogarty returned to the house shouting for some clothes. His partner passed a tracksuit to him and tried to ignore his behaviour. 

His nephew could hear him shouting so told him to go outside. He then kicked the door, trying to get into the property, and the police were contacted. 

When detained by police, he banged his head on the side of the van and sustained a cut. 

Defence solicitor David Bell said the couple had arrived back separately and Fogarty wanted to change because he was in a suit.

“Alcohol is not normally a big part of his life, neither is disorder,” he said. 

Sheriff Charles Macnair said: “This was an offence you committed when you consumed too much alcohol.

“You have a bad record.”

The sheriff imposed a community sentence of two years’ supervision.
