A FIGHT which started in a Dunfermline pub then spread out into the street, a court has heard.

Aaron Kyle, 33, of High Street, Lochgelly, appeared in the dock at Dunfermline Sheriff Court.

He admitted he repeatedly punched and kicked a man, who later spent the night in hospital for observation.

However, the court was told Kyle was reacting to provocation.

Kyle admitted that on December 3, 2017 at Maygate, Dunfermline, whilst acting with others, he assaulted the victim by repeatedly punching and kicking him on the head and body to his injury.

Depute fiscal Rebecca Clarke said the accused had been talking to a female in the Creepy Wee Pub.

He did not know the woman but her former girlfriend entered the pub and threw a glass at her and went for the accused.

“The accused took umbrage at this and engaged in an altercation. Tables and chairs were knocked over and glasses were smashed,” said the depute.

The two men were put out of the pub but the fight continued in the street with others becoming involved.

Kyle then responded to further provocation after the initial altercation had been broken up, the court was told.

He punched the complainer, who was later taken to the Victoria Hospital. He had a missing tooth and had struck his head on the ground.

Sheriff James MacDonald commented: “It’s correct to say the degree of provocation here was significant.” He admonished Kyle.
