A VALLEYFIELD man who assaulted his dad has been sentenced to 110 hours of unpaid work.

Mark Cook was out with his brother when their dad called over Facetime and an argument broke out between the two.

After he made his way to his dad's, they got into a fight, the court was told.

Cook, 24, of Main Street, Low Valleyfield, previously admitted that on December 20, at Garden Court, Townhill, he assaulted his father and struggled with him and repeatedly punched him on the head, all to his injury.

Depute fiscal Azrah Yousaf explained that at around 5pm, the accused met with his brother.

During that time his brother received a Facetime call from his dad, which started off amicably. But the conversation deteriorated and an argument ensued.

The court was told that Cook's dad said: "You are no son of mine. I brought you into this world and I will take you out of it."

Cook went to his dad's address and at 6.15pm a struggle began between the pair.

The accused punched his dad on the back of the head which was witnessed by the complainer's partner and the police were called.

However, father and son both ended up with injuries as a result of the fight.

Cook told officers that he was "acting in self-defence".

Defence solicitor James Moncrieff said: "The complainer is Mr Cook's father, who has had very little to do with Mr Cook throughout his life.

"The other person is his brother who I think has had more of a relationship with his father.

"A comment was made to Mr Cook. His father made enquiries about his grandchildren which Mr Cook was not happy about.

"He was invited to discuss the matter, he went along and a fight began.

"There is obviously bad blood between them.

"This was not a one-sided matter, they were both injured and Mr Cook had to have a CT scan."

Mr Moncrieff explained that Cook had been described as a "pleasant young man" in a social work report and he had refrained from alcohol since the incident.

"I think this happened on the back of a difficult relationship with his dad," he added.

Sheriff Charles Macnair said: "I accept that you were both injured but that is what happens if you start assaulting people.

"I recognise your lack of record and the nature of the offence and I am prepared to deal with this by way of a non-custodial sentence. "

As well as 110 hours of unpaid work Cook will be subject to 12 months of supervision.
