A KELTY man who carried out an unprovoked attack in a Dunfermline pub has been jailed for a year.

Kevin Low glassed his victim at the Seven Kings pub while out with friends for a birthday celebration.

Appearing for sentencing at Dunfermline Sheriff Court on Wednesday, Low, 35, of Croall Place, had previously admitted striking the complainer on the head with a glass tumbler on April 14.

A previous court hearing heard that the victim had been in the smoking area outside the bar with his partner where Low engaged in a conversation with him before punching him in the face while holding the glass. The victim sustained three cuts to his face.

Sheriff Alastair Brown said incidents "in or near" licensed premises had to be be treated very seriously.

"Assaults with glass tumblers have to be treated particularly seriously," he said. "You were fortunate not to have inflicted much more substantial injuries than you did. I have known people blinded on one side by somebody doing exactly what you did.

"That didn't happen on this occasion and I can take that into consideration. I also take into consideration your good character. I have heard what is being said about your family commitment and about your commitment to work. Nevertheless, this was an extremely serious offence for which the only possible sentence is imprisonment."

Low was jailed for 12 months and also banned from the Seven Kings for three years.

Sheriff Brown added: "That is the shortest sentence I have ever imposed for an offence of this sort."

Solicitor Gwen Haggerty said her client had no recollection of the incident.

"He cannot mitigate his actions," she said. "He is aware how lucky he is that there were no more serious consequences of his actions. He is very aware of the stress caused to the complainer.

"He is aware custody will be uppermost on the court's mind but there are alternatives available to the court. This is a hard-working man who supports his wife and his children from a previous relationship. He has a good work ethic."
