A MAN accused of raping a girlfriend while they were both high on the hallucinogenic drug LSD walked free from court on Tuesday after a jury found him not guilty.

David Gray, 21, was also cleared of holding the 21-year-old mum down on a bed and choking her after the jury returned a not proven verdict.

Gray insisted he had stopped having sex with the woman, who was then aged 18, when she told him she wasn’t enjoying it.

He lodged a special defence saying any sexual conduct was with the complainer's consent.

He told the High Court at Livingston that he went to sit in a corner to enjoy his “acid trip” alone.

He rejected prosecution suggestions that he had chased the young woman around the house naked before pinning her down on a bed and forcing himself on her, saying she had lied about what happened.

He also rejected the woman’s evidence that she had told him: " I’m not consenting. If you do this now it’s rape!”

Jurors based at a cinema complex 26 miles from the West Lothian court building took less than four hours to reach their majority verdicts.

They decided that the Crown had failed to provide enough evidence to prove the allegations beyond reasonable doubt.

Judge Lady Poole formally acquitted Gray, of Turnbull Grove, Dunfermline, and he left court with his relieved family.
