A man kicked and damaged his partner’s door in Rosyth after being locked out.

Thomas Fagan, 38, appeared at Dunfermline Sheriff Court.

He admitted that on August 31 at Primrose Lane, he acted aggressively, shouted and swore.

He also damaged a door by repeatedly kicking it.

Depute fiscal Sean Maher said the couple had been in an on/off relationship for around 10 years.

There had been an argument and altercation between them with Fagan kicking a door and shouting after leaving her home: “You’re a lying bitch.”

Police were called and found Fagan, of Hillview in Cowdenbeath, on a landing outside the property.

Defence solicitor Iain McCafferty said his client had been locked out of the house after going to a nearby shop.

“With the benefit of hindsight, he knows he should have just walked away but he wanted his phone back,” he added.

Sheriff William Gilchrist reminded Fagan he had previously been jailed for a domestic offence.

“You were given a term of imprisonment but here you are again having committed another offence,” he added.

The sheriff imposed a community payback order with two years’ supervision and participation in the Caledonian Programme for domestic offenders.
