A DUNFERMLINE man exposed himself outside a takeaway shop and shouted racial abuse.

Liam Kinch, 22, of Broomhead Drive, appeared in the dock at Dunfermline Sheriff Court on Wednesday.

He had previously admitted that on July 16, at Sizzlers Takeaway in Ballingry, he committed an offence of public indecency by exposing his genitals and making thrusting motions, placing his naked buttocks on the windscreen of a car and seizing his genitals and making suggestive remarks.

He also acted in a racially-aggressive manner which caused, or was intended to cause, alarm and distress to a person by shouting, swearing and uttering racist remarks.

Depute fiscal Rennie said Kinch was in a flat across from the takeaway shop and one of the witnesses observed him hanging out of the window and shouting and swearing randomly.

"He was quite clearly drunk and making sure he was being heard by passers by," she told the court. "He was then seen to jump off the balcony and head towards one of the witnesses' vehicles which was parked on the main road outside the takeaway shop.

"For no apparent reason, he pulled down his trousers and exposed his genitals in the middle of the street."

Kinch then put his buttocks on the windscreen of the car and shouted, swore and continued to act aggressively shouting abuse such as: "I hate f****** muslims" which led to witnesses feeling extremely scared and intimidated.

Solicitor Rosni Joshi said her client was "genuinely embarrassed" for his behaviour. "It is very much out of character for him to behave as he did," she said. "He accepts the behaviour was completely out of order and is ashamed."

Sheriff Alison McKay said he had done something "incredibly stupid".

"Your behaviour on this particular occasion was outrageous and unacceptable and, to be fair to you, you do accept that," she said. "What is a matter of concern to me is you were on a community payback order at the time of this offence and it is clear you have already got a well-documented history of abusing alcohol.

"I hope you will learn from this experience and we will not see you back here again."

She placed him on a community payback order requiring him to do 150 hours of unpaid work within nine months.
